1. About this Privacy Policy
1.1This Privacy Policy explains how orcalumi (ABN 49 294 045 089) (orcalumi, we, us or our), collects, uses, stores, discloses and protects personal information in connection with the Five Day Founder course, our websites, waitlists, applications, emails, community channels, events, recordings and related services (together, the Services).
1.2This Policy should be read together with our Five Day Founder Terms and Conditions. Capitalised words used but not defined in this Policy have the meaning given in those Terms and Conditions.
1.3To the extent the Privacy Act 1988 (Cth) applies to us, we comply with that Act and the Australian Privacy Principles (APPs). Even where the Privacy Act does not strictly apply, this Policy explains how we aim to handle personal information responsibly and consistently with good privacy practice.
1.4By using the Services, enrolling in a Cohort, subscribing to our waitlist, attending an event, joining a community channel or otherwise providing us with personal information, you consent to the handling of your personal information as described in this Policy. If you do not agree, please do not use the Services.
2. What personal information we collect
2.1The personal information we collect depends on how you interact with us. It may include:
- Identity and contact details: name, email address, phone number, country, city, time zone, business name and social handles you provide.
- Enrolment and application details: selected Tier, Cohort, discount codes, referral source, application answers, business idea, goals, background, experience level and any accessibility or scheduling requirements you tell us about.
- Payment and billing information: billing name, billing email, billing country, transaction reference, amount paid and payment status. We do not collect or store full credit card or bank account numbers; payments are processed by a third-party payment processor.
- Course participation information: Live Session attendance, Zoom chat messages, questions, community posts, support requests, submissions, checkpoint completions, product demos, files you choose to share, product URLs and feedback.
- Recordings and images:audio, video, chat, screen-share and screenshots from Live Sessions, office hours, workshops, Q&A sessions and Demo Day where recording is enabled.
- Business and promotional information: business name, product name, logo, product description, website, LinkedIn/X handle, screenshots, demo links and other information you voluntarily share for feedback, Demo Day, case studies or launch amplification.
- Communications: emails, waitlist submissions, application forms, survey responses, support requests, direct messages, feedback, testimonials and other communications you send us.
- Website, analytics and advertising information: IP address, device type, browser type, operating system, pages visited, referring URL, interactions with our website or emails, cookie identifiers, ad-click data and similar technical information.
- Event and community platform information: RSVP status, attendance data, profile information and messages from platforms such as Meetup, Zoom, Discord, Slack, YouTube, LinkedIn or other channels where you interact with us.
2.2We do not intentionally collect sensitive information as defined in the Privacy Act, such as health information, biometric information, religious beliefs or political opinions. Please do not submit sensitive information to us unless we specifically request it and you consent to that collection.
2.3The Services are intended for adults. We do not knowingly collect personal information from anyone under 18 years of age.
2.4If you provide personal information about another person, for example a co-founder, team member, customer or lead, you confirm that you have their permission to do so and that you have told them about this Policy where required.
3. How we collect personal information
3.1We collect personal information:
- directly from you, when you enrol, apply, join the waitlist, contact us, attend a Live Session, post in a community channel, complete a form, submit work, share a product demo or otherwise interact with us;
- automatically, when you visit our websites, open our emails, click our links or interact with our ads, using cookies, pixels and analytics tools where enabled;
- from third-party service providers, such as payment processors, event platforms, video-conferencing platforms, community platforms, email platforms and analytics providers;
- from public sources, such as your public website, LinkedIn profile, X profile, GitHub profile or publicly available business information, where relevant to delivering the Course or responding to your enquiry; and
- from referral partners or community organisers who introduce you to us, where permitted by law.
4. How we use personal information
4.1We use personal information to:
- process applications, enrolments, payments, receipts and invoices;
- deliver the Course, including Live Sessions, recordings, the Vault, community access, office hours, 1:1 reviews and support;
- verify Tier access, attendance, checkpoint completion and eligibility for the Friday Ship Guarantee;
- respond to questions, support requests, refund requests and feedback;
- operate, maintain, improve and secure the Services, Course Materials, website, community channels and internal systems;
- tailor Course delivery, examples and support to the Cohort’s needs;
- send administrative messages about the Course, including session links, setup instructions, reminders, recordings, schedule changes and policy updates;
- send marketing communications about future Cohorts, workshops, new Claude primitives, case studies, content and occasional discounts, where you have subscribed or where otherwise permitted by law;
- run analytics, measure traffic, understand audience behaviour, improve the website and assess the effectiveness of content, ads and campaigns;
- with your permission or where you have not opted out, reference your name, business name, logo, public product URL, screenshots and high-level product description for case studies, social media, launch amplification, testimonials and promotional material;
- protect our rights, prevent fraud, misuse, security incidents and unlawful conduct, and enforce our Terms and Conditions; and
- comply with legal, tax, accounting, regulatory and dispute-resolution obligations.
4.2We do not sell personal information. We do not use your personal information to train third-party AI models.
5. AI tools and Third-Party Tools
5.1The Course teaches and uses Third-Party Tools, including AI tools. You may use your own AI, developer, hosting, database, payment, email and analytics accounts during the Course. Your use of those tools, including any Claude subscription, Anthropic API usage, Claude Platform usage, Claude extra usage or paid upgrades, is governed by the relevant third-party provider’s terms, pricing terms and privacy policy.
5.2We may use AI tools internally to help operate the Services, such as to draft administrative messages, prepare materials, summarise feedback, organise support requests or improve Course content. Where we do so, we use them under our own accounts and aim to avoid entering unnecessary personal information.
5.3You should not share sensitive personal information, confidential third-party information, production customer data, banking information, regulated data or live credentials in Live Sessions, community channels, AI prompts, shared documents, MCP servers or demo environments unless you have independently assessed the risks and have all necessary rights and permissions.
5.4If you choose to share files, product information, code, customer data or other information for feedback or support, we will use that information to deliver the Services and handle it in accordance with this Policy.
5.5Where you purchase, subscribe to or upgrade Third-Party Tools directly, those providers may collect and process your account, billing, usage, telemetry, product and support information under their own privacy policies. We do not control those providers, and we generally do not receive full payment card details or detailed usage records from accounts you create directly with them.
6. Who we disclose personal information to
6.1We disclose personal information only where reasonably necessary for the purposes described in this Policy, including to:
- our personnel, contractors, instructors, assistants and professional advisers who need the information to deliver the Services or run our business;
- service providers and platforms we use to operate the Services, including payment processors, Zoom or comparable video platforms, Discord and/or Slack, Google Workspace, email delivery tools such as Resend or similar providers, website hosting providers, analytics providers, advertising platforms, AI providers such as Anthropic/Claude where used for Course operations, and customer-support tools;
- other Participants in your Cohort to the extent you choose to share information in Live Sessions, chat, community channels, shared boards, Demo Day or group support contexts;
- referral partners, community organisers or affiliates where necessary to validate a referral, discount or partner arrangement;
- a purchaser, successor or potential purchaser if we sell, restructure or transfer all or part of our business, subject to appropriate confidentiality obligations; and
- government bodies, regulators, courts, law enforcement, payment processors or other parties where we are required or permitted by law, need to enforce our rights, or need to protect safety, security or integrity.
6.2We do not disclose personal information for third-party advertising unrelated to our own Services. Where we use advertising platforms, we use them to measure and promote our own Services.
7. Overseas disclosure and international participants
7.1We are based in Australia and the Services are offered remotely to participants in Australia and overseas. By using the Services, you acknowledge that your personal information may be transferred to and processed in Australia.
7.2Some service providers we use are based outside Australia or store information on servers outside Australia. This means your personal information may be disclosed to, stored in or accessed from countries including the United States, the European Union, the United Kingdom and other locations where our service providers operate.
7.3Where we disclose personal information overseas, we take reasonable steps to use reputable providers with appropriate contractual, technical and security safeguards.
8. Recordings of Live Sessions
8.1Live Sessions, workshops, office hours, Q&A sessions and Demo Day may be recorded, including audio, video, screen share and chat. By turning on your camera or microphone, posting in chat, sharing your screen or otherwise participating, you consent to being recorded.
8.2We use recordings to deliver the Course to Participants who could not attend live, make recordings available for the relevant access period, improve future Cohorts, respond to support requests and create limited promotional excerpts.
8.3We use reasonable efforts to avoid featuring any individual Participant externally without consent. If you prefer not to appear in a recording, keep your camera and microphone off, use chat for questions where practical, and avoid screen-sharing personal or confidential material.
8.4If you appear in a recording and would like us to edit or remove your contribution where reasonably practical, contact us using the details in clause 15. We may not be able to remove all references, especially where the recording has already been distributed to enrolled Participants or the contribution is incidental.
9. Marketing, testimonials and promotional use
9.1We may send you marketing communications about future Cohorts, workshops, Course updates, Claude-related content, case studies and occasional discounts where you have subscribed, enrolled or where otherwise permitted by law.
9.2Every marketing email includes an unsubscribe link. You can opt out at any time by using that link or contacting us. Opting out of marketing does not affect administrative messages about your Cohort, purchase, account, support request or legal notices.
9.3If you do not want your name, business name, logo, public product URL, screenshots or product description featured in case studies, social media, website, launch amplification or other promotional material, you can opt out in writing at the time of enrolment or later by contacting us.
9.4We may use de-identified or aggregated information, such as number of products shipped, common questions, tool preferences or cohort outcomes, for analytics, reporting, marketing and improvement purposes.
10. Cookies, analytics and advertising technologies
10.1Our websites and emails may use cookies, pixels and similar technologies to make the site work, remember preferences, understand how visitors use the site, improve content, measure email engagement and assess advertising performance.
10.2The tools we use or may use include website analytics, email analytics, Google advertising products, Meta advertising products, LinkedIn advertising products, YouTube/Google measurement tools and similar services. These tools may collect or receive information from our websites, emails or ads and use it according to their own policies.
10.3You can control cookies through your browser settings and, where available, through cookie banners or platform settings. Blocking some cookies may affect how the website works or how accurately we can measure campaign performance.
10.4If required by law, we will ask for consent before using optional cookies or advertising technologies.
11. Security and storage
11.1We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These steps may include access controls, encrypted connections, reputable service providers, multi-factor authentication where available, secure password practices, role-based access and staff/contractor confidentiality obligations.
11.2No method of transmission or storage is completely secure. While we work to protect personal information, we cannot guarantee absolute security.
11.3If we suspect a data breach, we will assess it and take appropriate steps. Where required by the Notifiable Data Breaches scheme or other applicable law, we will notify affected individuals and/or the Office of the Australian Information Commissioner.
12. How long we keep personal information
12.1We keep personal information only for as long as we need it for the purposes described in this Policy or as required by law.
12.2For example, we may retain enrolment, payment, support and legal records for the period necessary for accounting, tax, dispute-resolution and legal-compliance purposes. Australian tax and business records may need to be retained for at least five years.
12.3When we no longer need personal information, we take reasonable steps to delete, destroy or de-identify it, unless we are required or permitted by law to keep it.
13. Access, correction, deletion and complaints
13.1You may ask us for access to the personal information we hold about you, and you may ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in clause 15.
13.2You may also ask us to delete personal information we hold about you. We will take reasonable steps to do so unless we are required or permitted by law to keep it, or unless deletion would prevent us from complying with legal, accounting, tax, dispute-resolution or security obligations.
13.3If you think we have breached the APPs or this Policy, please contact us first so we can try to resolve it. We will respond within a reasonable period. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at www.oaic.gov.au.
13.4If you are located outside Australia, you may have additional rights under local privacy laws. We will consider valid requests in accordance with applicable law.
14. Changes to this Privacy Policy
14.1We may update this Policy from time to time. The current version is shown at the top of the document. Where changes are material and affect current Participants, we will notify them by email, the Course platform or the relevant community channel.
14.2The version of this Policy in force at the time of collection will generally apply to the personal information collected at that time, subject to any later update notified to you or otherwise permitted by law.
